Types of Felony Offenses & Penalties

Texas law has five felony classifications for criminal offenses:

  • Third Degree Felony: A third degree felony carries a fine up to $10,000, and a those convicted could also face between two and ten years in prison, or probation.

  • First Degree Felony: A first degree felony carries a fine up to $10,000, and if convicted, first degree felony crimes carry long-term potential incarceration of up to 99 years in prison. Some first-degree felonies, like aggravated sexual assault have mandatory minimum sentences of 25 years.
  • Capital Felony: According to Texas law, there is only one capital felony, murder. A capital murder charge carries a fine of $10,000 and possible life in prison or death.
