What is aggravated assault?
Aggravated assault, commonly known as assault with a deadly weapon, is a criminal charge given to those accused of threatening violence with a weapon. This is not to be confused with a charge of battery, which is given to those who actually inflict physical harm. However, oftentimes aggravated assault and battery charges will go hand in hand.
Texas law can have a wide interpretation of what constitutes a deadly weapon, including:
- Machine gun
- An explosive
- Knife or dagger
- Club or bat
Defending Against Charges of Assault with a Deadly Weapon
If you have been charged with aggravated assault, you will quickly find yourself in the complex world of the criminal justice system. You may not understand the charges against you or what you can do to protect yourself. You may find the police used intimidation or other unfair tactics to obtain a statement from you. You may discover that no one is listening to your side of the story. And you will quickly realize that you cannot handle these charges on your own.
