Penalties for Possession of Drug Paraphernalia
According to Texas law, drug paraphernalia is defined as any item that can be used as a drug processing, packaging, or consumption mechanism. Simple possession of drug paraphernalia is a Class C misdemeanor, which is punishable by a $500 fine.
However, a conviction of distribution or possession with intent to distribute or sell drug paraphernalia is a Class A misdemeanor, which is punishable by a jail sentence of one year. Selling drug paraphernalia to someone under 18 years old is considered a state jail felony. It is important to understand that a drug conviction of any kind will result in suspension of your driver’s license. Even if you were not operating a motor vehicle at the time of the alleged crime, a driver’s license suspension would apply upon conviction.
